Terms and Conditions
These terms and conditions (“Terms”) form a rental agreement between Wedding Chair Hire (the “Supplier”) and you, the person hiring the equipment (the “Hirer”). By placing a booking, you agree to these Terms.
Booking & Payment
- Your Booking: A booking confirmation establishes a contract between you and Wedding Chair Hire.
- Payment: Full payment is required before the event via EFT or credit card.
- Credit Card: A 2% surcharge applies for Visa and Mastercard only. 3.5% surcharge applies to American Express.
- Cash on Delivery: Only accepted if the Hirer is present at delivery. Exact change is required. We reserve the right to withhold delivery or charge your credit card if cash payment is unavailable.
- Price Changes: We reserve the right to adjust prices without notice.
Security Deposits & Credit Card Authorisation
- We may request a credit card authorisation or bond to cover damages, theft, cleaning, or retrieval issues. By booking, you authorise us to charge your card for lost, stolen, damaged, unclean, or uncollected equipment.
Cancellations
- Cancellation Fees:
- Outside of 48 hours: 50% non-refundable fee.
- Within 48 hours: 100% cancellation fee.
- Reduced order quantities: Same cancellation fee structure as above.
- We reserve the right to charge your credit card for cancelled bookings.
Rental Period & Late Returns
- Rental Period: One day unless mutually agreed upon in writing. Late returns incur a daily fee deducted from the bond or charged to your credit card. We may enter the premises to retrieve overdue equipment without liability for property damage.
Equipment Responsibility
- Liability for Equipment: The Hirer is fully responsible for the equipment from pick-up to return. You are liable for replacement costs of stolen, missing, vandalised, broken, or damaged equipment.
Delivery & Set-Up
- Someone Must Be Present: The Hirer must have someone available to receive the equipment at the scheduled time. Re-delivery fees apply if no one is present.
- Delivery Location: Delivery is to ground level only. Additional charges apply for distances exceeding 10 meters from the parking location, stairs, inclines, or building access. The Hirer is responsible for notifying us of these conditions. Failure to do so may result in additional charges or refused delivery. These charges will be deducted from the bond, charged to your credit card, or require cash payment on delivery.
- Set-Up: We do not set up most equipment (exceptions: dance floors). Instructions are provided, and additional set-up assistance is available for an hourly fee.
Dance Floor Products
- Recommended Use: Dance floor products are designed for indoor use only, and are not prohibited for outdoor use.
Safety & Operation
- Hirer Responsibility: The Hirer assumes responsibility for the safe operation and handling of the equipment according to Occupational Health & Safety (OH&S) guidelines. Wedding Chair Hire is not liable for any injuries sustained during equipment movement or set-up.
Equipment Ownership & Transfer
- Equipment Ownership: The equipment remains the property of Wedding Chair Hire at all times. The Hirer cannot transfer this contract to another party without written consent.
Equipment Inspection
- Inspection & Reporting: The Hirer must inspect the equipment upon delivery and notify Wedding Chair Hire immediately of any missing, damaged, or unusable equipment. Failure to do so makes the Hirer responsible for any damages or missing equipment upon pick-up.
Warranty Disclaimer
- No Warranty: Wedding Chair Hire does not offer any warranty regarding the equipment’s fitness for a specific purpose.
Governing Law
- Governing Law: This agreement is governed by the laws of New South Wales (NSW). Any legal proceedings will be held in NSW courts.
Indemnification
- Indemnification: The Hirer agrees to defend, indemnify, and hold the Wedding Chair Hire harmless from any claims, damages, losses, lawsuits, etc., arising from the use of the equipment.
Amendments & Agreements
- Amendments: Only Wedding Chair Hire can amend these Terms.
Entire Agreement & Severability
- Entire Agreement: These Terms constitute the entire agreement between the Hirer and Wedding Chair Hire and supersede all prior or contemporaneous communications or agreements, whether oral or written. This agreement is binding on the heirs, successors, and assignees of both parties.
- Severability: If any provision of this agreement is found to be invalid or unenforceable, that provision shall be modified or limited only to the extent necessary to make it valid and enforceable. The remaining provisions will remain in full force and effect.
Waiver & Remedies
- Waiver: A waiver of any breach of these Terms does not constitute a waiver of any other or subsequent breach. A delay or omission by either party in exercising any right or remedy under this agreement shall not be construed as a waiver of such right or remedy.
Headings
- Headings: The headings used in these Terms are for convenience only and do not constitute part of these Terms and do not affect their interpretation.
